Terms of Service

What Bathysia is, what we ask of you, and what we owe you in return — the whole agreement, without padding it out to look more serious than it is.

01 The short version

Bathysia is free to play, forever, for the whole base game. Play fair, don’t automate your way past discovery, and don’t sell or share your account. If you ever pay for something, you’re buying Nauts — never an advantage another pilot couldn’t also reach by playing. We’ll try hard not to lose your progress; if a bug ever does, we’re sorry in advance and we’ll do what we reasonably can, and anything you’ve actually paid for is what we treat as sacred to restore.

02 What Bathysia is

Bathysia is a browser game about piloting a drone into deep water, discovering creatures, and building an expedition. The core game is free, with no signup wall — ever. You can play an entire session as a guest with no account at all, covered in full in our Privacy Policy. Some content may later be reached only through play — levels, quests, storyline — rather than sold as an unlock; nothing in the base game is a paywall dressed up as a feature.

03 Who runs Bathysia

Bathysia is made and operated by S3P4 CODE S.R.L., a company registered in Romania (CUI 50282382), with its registered office at Str. Principala, nr. 1.H.1, Gaureni, Iasi, Romania. These terms are governed by the laws of Romania, and any dispute that isn’t resolved directly between us falls under the jurisdiction of the Romanian courts — except where the mandatory consumer-protection law of your own country gives you the right to bring a claim there instead (see §11).

04Accounts & fair play

  • One account, one person — don’t share, sell, or trade accounts.
  • Keep your sign-in email accurate; it’s the only way back into a cloud save.
  • No cheating: no save editing, no macro or bot automation beyond what Fleet Dispatch legitimately does for you while you’re away, no exploiting bugs for material advantage instead of reporting them.
  • No harassment, hate speech, or abuse toward other pilots in any social feature we ship.
  • We can suspend or remove an account for clear abuse of the above — including cheating, exploiting the Nauts economy, or reversing a payment you made — and we’ll always tell you why if we do.
  • You can delete your own account at any time from the in-game Account panel. It’s permanent, and it’s covered in full in the Privacy Policy.

05Purchases & refunds

Nauts — Bathysia’s one real-money product — are live in the game; see the Shoppage for what they’re for. Payments made on bathysia.com are processed by Stripe on its own hosted checkout page; we never see or store your card number ourselves. If you ever buy through a portal or platform storefront instead of bathysia.com directly, that platform’s own payment system and terms apply to that purchase, not this section.

If you’re an EU/EEA consumer, you have a 14-day right to withdraw from an online purchase under EU consumer law. Because Nauts are credited to your account immediately after payment clears — so you can spend them right away — checking out means you’re expressly asking for that immediate delivery and acknowledging that your withdrawal right ends once delivery is complete, the same way it works for any digital content delivered instantly. This doesn’t take away any other statutory right you have as a consumer.

Outside that window, refunds aren’t automatic — write to us at the contact below and we’ll look at your situation case by case. Refunding a charge doesn’t automatically claw back Nauts you’ve already spent.

06 Virtual goods: Nauts

Nauts are a limited, revocable, non-transferable license to spend inside Bathysia — not property, currency, or an investment. They have no monetary value outside the game, can’t be exchanged, redeemed, or cashed out for real money, and can’t be sold, gifted, or transferred between accounts or players. We can change what Nauts cost, what they can be spent on, or retire them entirely as the game evolves; we can also revoke Nauts, or the account holding them, for fraud, chargebacks, or a violation of these terms.

07Acceptable use & ownership

Don’t reverse-engineer, decompile, or build tools that automate your way around the Nauts economy or any other paid system — Fleet Dispatch’s own automation is the one exception, because it only ever runs on discoveries you made yourself. Everything else in Bathysia — the art, the writing, the drone designs, the code, the Bathysia name — belongs to S3P4 CODE S.R.L. or its licensors. Playing the game gives you a personal, non-commercial license to enjoy it, not any ownership over it.

08Progress, bugs & no promises

We test before we ship, but this is a small, actively-developed game, and bugs happen. If one costs you progress, we’re genuinely sorry, and we’ll do what’s reasonably possible to make it right — but we can’t promise every loss is recoverable. Anything you’ve actually paid for is the one thing we treat as sacred: if a purchase is ever lost to a bug, restoring it is our priority.

09Service “as is”

Bathysia is provided “as is” and “as available.” To the extent the law allows, we don’t promise the game will be uninterrupted, secure, error-free, or available every minute of every day; we don’t promise your save or purchase data will never be lost, though keeping it safe is something we actively work at (see §08); and we don’t warrant Bathysia is fit for any particular purpose beyond what it plainly is — a deep-sea piloting game you play in a browser. The game may change, be rebalanced, add or remove content, or be discontinued at any time; we’ll give notice when we reasonably can, but nothing here is a guarantee that it won’t happen.

10 Limitation of liability

To the maximum extent permitted by applicable law, S3P4 CODE S.R.L.’s total liability to you for any claim arising out of or related to Bathysia — however it arises — is limited to the greater of (a) what you paid us in the 12 months before the claim arose, or (b) $50. This cap does not apply to, and nothing in these terms excludes or limits, liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, intentional misconduct or gross negligence, or any other liability that cannot lawfully be limited or excluded under the law that applies to you. If you’re a consumer, this section doesn’t affect any right you hold under the mandatory law of your country of residence that we can’t lawfully override (see §11).

11 Your rights as a consumer

Nothing in these terms takes away any right you hold under the mandatory consumer-protection law of the country you live in — where a term above conflicts with a right you can’t lawfully sign away, your local law governs instead. If you’re an EU consumer, that can also include the right to bring a claim in the courts of your own country rather than Romania’s.

12 Changes to these terms

We’ll update this page as the game grows — new systems, new purchases — and post the date each time. Continued play after an update means you accept the current version; material changes get a note in the news log too.
